J&K: Court never liked to call Senior Officers at drop of hat but presence sought to uphold rule of law: CAT

Srinagar, Nov 12: In C.P./55/2025 (SRINAGAR) In O.A./54/2025  titled BILAL AHMAD RESHI Vs PUBLIC WORK DEPARTMENT R AND B after hearing CAT ordered as under:-

1. The instant C.P. arises out of an order passed by this Court in O.A./54/2025 dated 29.01.2025. The operative portion of the same reads as under: In view of the limited prayer made by the learned counsel for the applicant, the respondents are directed to consider and decide the applicant’s reply, which was submitted in response to the memorandum of charges, within a period of six weeks from the date of receipt of the certified copy of this order.

The respondents shall pass a reasoned and speaking order in accordance with law, particularly in light of the communications dated 11-09-2023 and 30-09-2023.

2. The respondents have filed their Compliance/Statement of Facts. Learned counsel for the petitioner, Mr. Hilal Ahmad Wani submits that the compliance is not in tune with the order passed by this Court dated 29.01.2025.

3. The respondents are directed to pass appropriate orders within ten days positively in tune with the order passed by this Court dated 29.01.2025.

It is made clear that in case needful is not done, Chief Engineer, PMGSY, Srinagar, to be present before this Court in person.

The presence is sought in order to assist this Court in disposing of the matter expeditiously.

Needless to say, this Court has never liked to call senior officers at the drop of the hat but the presence is sought only to uphold the rule of law.

4. List this matter as case no. 1 on 26.11.2025.
