Jammu, Nov 11: In T.A./122/2025 (JAMMU) in WPC-2275/23 titled SEEMA NARGOTRA Vs UNIVERSITY OF JAMMU For Applicant(s) Advocate : Mr. Sanjay Gupta For Respondent(s) Advocate : Mr. Anil Sethi after hearing CAT ordered as under:-
Vide judgment dated 13.05.2022, passed by the Hon’ble High Court of Jammu and Kashmir at Jammu in WP(C) No. 2040/2020 titled S. Harjeet Singh Raina vs. University of Jammu and Another, it was observed that the petitioner, Dr. Seema Nargotra, can be adequately safeguarded by restricting the movement of the contractor (petitioner in the said writ petition) within the University campus, in such a manner that his visits, if at all necessary, shall be only for supervising the ongoing works under the supervision of a University official.
The Hon’ble High Court further directed the University to take a fresh call regarding the entry of the petitioner into the University premises. Pursuant to the said direction, a Committee was constituted vide Order No. Adm/TW/22/653-58 dated 26.05.2022, which made five recommendations.
However, it is surprising and a matter of concern that despite the clear directions of the Hon’ble High Court, which categorically restricted the contractor to supervision of existing works only and prohibited allotment of any new work, fresh contracts were still awarded to him.
Upon interaction with University officials, it has come to light that contracts have been allotted to the Contractor Harjeet Singh, in clear violation of the Hon’ble Court’s order.
Accordingly, the Registry shall issue a show-cause notice to the Registrar, University of Jammu, to explain why contempt proceedings should not be initiated against him for awarding fresh contracts to the said contractor in contravention of the Hon’ble High Court’s order dated 13.05.2022.
The petitioner, Dr. Seema Nargotra, is also granted liberty that, in the event the said contractor is found within her residential complex, she may lodge an FIR before the SSP Jammu, who shall take immediate action against the concerned person.
The Registrar, University of Jammu, is further directed to file a personal affidavit stating how many contracts, if any, have been granted to the said contractor after the passing of the Hon’ble High Court’s order.
This matter pertains to the safety and security of women employees of the University.
Such individuals shall not be permitted entry into the University campus in the future.
