High Court seeks Affidavit from J&K Govt "Whether there is any legal regime relating to phasing out of BS-III non-commercial vehicles"

Jammu, Nov 02: In WP(C) No. 2902/2022 c/w WP(C) No. 2889/2022  titled Thakur Balwan Singh Vs UT of J&K & Ors. after hearing  HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDERED as under:-

 01. Mr. Eishaan Dadhichi, learned GA for the respondents is requested by this Court to apprise this Court, in the light of the Govt. Order No. 08-JK (TR) of 2022 dated 07.02.2022, as to whether all private personal vehicles are allowed to ply in the UT of Jammu & Kashmir irrespective of the year of manufacturing and type of vehicle, be it BS-I, BS-II, BS-III and further.

He shall also inform whether there is any legal regime operating in the UT of Jammu & Kashmir relating to the phasing out of BS-III non-commercial vehicles.

The requisite affidavit to this effect shall be filed by or before the next date of hearing.

02. Failure to do the needful may result in an adverse order at the risk and cost of the respondent No. 2 – Transport Commissioner, UT of Jammu & Kashmir.

03. List in continuation on 20.11.2025.
