J&K:CAT issues Bailable Warrants against Comm/Sec with 02 surety bonds of Rs. 25,000/ each to be executed by SSP

Jammu, Aug 19: In C.P./370/2024 (JAMMU) [ CONTEMPT ] In O.A./576/2022 With M.A./809/2025  titled JITENDER MISHRA Vs GENERAL ADMINITRATIVE DEPARTMENT after hearing CAT ordered as under:-

The instant Contempt Petition (in short C.P.) No. 370 of 2024 has been preferred by the applicant being aggrieved of the noncompliance of the order dated 28.08.2024 passed by this Tribunal in Original Application bearing No. 61/576/2022 titled “Jitender Mishra vs. UT of J&K”

2. The C.P. was listed today, and on perusal of record, it was shockingly revealed that the contemnors have been granted several opportunities to file the compliance report in pursuance to the order passed in the main case, but they have still failed to file the compliance report.

3. Vide order dated 01.05.2025, bailable warrant had been issued against the Commissioner/Secretary to Govt. General Administrative Department, Govt. of J&K, Jammu. Vide order dated 03.06.2025, Mr. Sudesh Magotra, ld. AAG submitted that the petitioner's case had been placed before the Establishment-cumSelection Committee for consideration. So, the bailable warrant against the GAD was recalled and granted more time for compliance.

Further, vide order dated 16.07.2025, the contemnors have been granted opportunities with sufficient time to file the compliance report, failing which the Erring Officers were directed to remain present before this Court on the next date of hearing and explain why contempt proceedings be not initiated against them.

Despite issuance of said orders, the contmenors have neither filed the compliance report nor did they bother to appear through video conferencing before this Court with explanation as to why the compliance has not been filed yet.

4. Since the contemnors have failed to appear before this Court today as well, as per the directions given on the previous dates of hearing, we are left with no other option but to issue bailable warrants with two surety bonds to the tune of Rs. 25,000/- (Rupees Twenty-Five Thousand only) each for ensuing presence of contemnor no. 1 i.e., Sanjeev Verma, IAS Commissioner/Secretary to Govt. General Administration Department Govt. of J&K Civil Secretariat, Jammu-180001, before this Court on the next date of hearing positively.

5. The Senior Superintendent of Police, Jammu is directed to execute this bailable warrant and ensure the presence of abovementioned contemnor.

6. List the matter on 18.09.2025.
