High Court to pass "Adverse Orders"  if Revenue Secretary/DC Jammu & others fail to file reply?

Jammu, Aug 11: In WP(C) No. 2850/2022 c/w WP(C) No. 1330/2023 titled Vandana Sharma & Anr Vs UT of J&K & Ors. after hearingHON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDERED on 21.05.2025 as under:-

01. Mr. Mohit Kumar, learned counsel for the petitioners submits that the petitioner No. 2-Puneet Kour in WP(C) No. 1330/2023, intends to withdraw herself from the writ petition.

The oral plea made by Mr. Mohit Kumar, learned counsel on behalf of the petitioner No. 2 is accepted. Writ petition bearing WP(C) No. 1330/2023 with respect to the petitioner No. 2-Puneet Kour shall be deemed to have been dismissed for non-prosecution.

02. It is pertinent to mention here that the petitioner No. 1- Supinder Kour in WP(C) No. 1330/2023 is the first one to withdraw herself from the writ petition as is born out from order dated 31.07.2023 meaning thereby the writ WP(C) No. 2850/2022 c/w connected matter petition bearing WP(C) No. 1330/2023 is only to be pursued by the petitioner No. 3-Vandana Sharma and the petitioner No. 4-Smt. Singh Kanta Mangal.

03. The petitioners No. 3 and 4 are directed to file fresh Memo of Parties within a period of fifteen days.

04. In WP(C) No. 1330/2023, the petitioners No. 3 and 4 are under a direction to take steps for service of the private respondents, who figure respondents No. 3 and 4 in WP(C) No. 2850/2022 and as respondents No. 4 and 5 in WP(C) No. 1330/2023.

In addition, the respondent No. 6 in WP(C) No. 1330/2023 is also needed to be served.

05. Petitioners are thus, directed to take steps in both the writ petitions for service of the un-served private respondents by depositing registered postal covers within a period of seven days whereupon notice to go to private respondents.

06. The official respondents are directed to come forward with the reply/response to the writ petitions within a period of four weeks.

07. Considering the fact that both the writ petitions are dating back to the year 2022-23 and, as such, the official respondents are given last and final opportunity of coming up with the reply/response to the writ petitions, failing which, any adverse order in the case shall be at the cost and risk of the defaulting official respondents.

08. List on 15.07.2025.

09. Interim directions, if any, to continue till the next date of hearing.

Experts who are aware of the issue speaking to CTN said "However, again the said case has been listed on 17.10.2025 & details of listings & appearance of Govt Counsel can be verified causing final disposal of case over a fraud itself detected by DC Office Jammu but DC Office itself not following the case properly, otherwise it is proved from the court order that main attorney holder, who made all 04 registries, his wife & one another has withdrawn cases from High court following which fraud mutations entered by Revenue Officers stands cancelled.

It raised some questions on DC Office & Govt Counsel that they would have filed a CMP for early hearing by bringing the facts of withdrawal of main WP(C) 94/2022 filed by wife of attorney holder, who get four registries registered in court following which plot was vacated clearly speaks that other registries are also on fraud base, which stands cancelled by DC Office Jammu itself but subject to outcome of WP's vide No. DMJ/LO/23-24/151-54  Dtd. 13.04.2023, and  case not being decided on the fault of Office of Secretary Revenue, DC Office  & Tehsildar Bahu Jammu being respondents for replies or other related matters.
