Gaziabad, Aug 11: The Hon’ble Special Judge, Anti-Corruption, CBI, Court, Ghaziabad has convicted and sentenced accused Public Servant namely Rakesh Babu Garg (R.B. Garg) the then Executive Engineer (C), CPWD, New Delhi to 3 Years Rigorous Imprisonment (RI) with a fine of Rs. 50,000/- in Disproportionate Assets (DA) case.
The instant Disproportionate assets Case was registered on the basis of recovery of incriminating documents and articles against the public servant in a trap case dated 13.10.2010. The accused Sh. R.B. Garg was arrested on 18.10.2010.
During his police custody, Sh. R.B. Garg made disclosure of having accepted bribe and led the CBI team including independent witnesses to Agra, where a sum of Rs.85.00 lacs in cash was recovered at his instance.
Accordingly, the instant DA Case was registered on 24.08.2011 against accused Shri R.B. Garg on the allegation of having in possession huge disproportionate assets beyond his known sources of income. Investigation revealed that during the check period i.e. 01.01.2005 to 19.10.2010, accused R.B. Garg was in possession of disproportionate assets to the tune of Rs. 87,53,801/-, against his income of Rs. 35,00,770/-, which he could not satisfactorily account for.
After investigation, Chargesheet was filed by CBI on 18.12.2012 against Rakesh Babu Garg, the then Executive Engineer, CPWD, New Delhi. Charges were framed by the Court on 06.09.2013 against the accused person.
During trial 54 PWs were examined on behalf of prosecution. After the trial, the Court convicted the accused and sentenced him accordingly.
