JAMMU, Aug 1: The Central Administrative Tribunal, Jammu Bench comprising Rajinder Singh Dogra (Judicial Member) and Ram Mohan Johri (Administrative Member) has directed the Government to reconsider the promotion and regularization dates of 18 police officers who were earlier appointed as Deputy Superintendents of Police on an officiating basis in the year 2000.
The applicants argued that they had been promoted to the rank of DySP before the appointment of direct recruits of 2002, yet their regularization-done via Government Order No. 367 (P) of 2007-was unfairly backdated after those recruits.
They sought corrections either from March 2000 or from dates vacated by their seniors. While the respondents opposed the petition, the Tribunal ordered the Home Department to treat the application as a representation and decide the matter afresh
The CAT directed the Government to consider the case in light of the Supreme Court’s 2000 ruling in Suraj Prakash Gupta & Ors. Versus State of J&K, which held that if an individual is eligible and a vacancy exists, regularization should be from the date of in-charge appointment.
Tribunal gave eight weeks to issue a reasoned and speaking order, emphasizing fair treatment and timely communication of the outcome to all applicants.
