CAT seeks "PA" of Shaleen Kabra to explain why coercive action not be initiated against for deliberate defiance, if fails

Jammu, June 09: In C.P./363/2024 (JAMMU) In O.A./1104/2021 RECOVERY C.P./258/2024 SEHDEV SINGH Vs SHALEEN KABRA, IAS, COMMISSIONER CUM SECRETARY, D/O JAL SHAKTI after hearing CAT ordered as   under:-

It is noted with concern that, despite repeated opportunities, the contemnors/respondents have failed to file the compliance report as directed by this Court. Their continued non-compliance demonstrates a willful disregard for the orders of this Court.

Accordingly, the contemnors/respondents are granted a last and final opportunity to file the compliance report, failing which they shall remain personally present before this Court on the next date of hearing to explain why coercive action should not be initiated against them for deliberate defiance of the Court's directions.

It is further brought to the notice of this Court that the respondents, after having their plea dismissed by the Hon’ble High Court of Jammu & Kashmir, have now approached the Hon’ble Supreme Court by filing a Special Leave Petition (SLP).

Mere pendency of the said SLP, however, shall not absolve the contemnors from complying with the binding directions issued by this Court.
