LG Manoj Sinha makes "Amendments" in "Prison Manual, 2022": Clarify on "Habitual Offender"

Jammu, May 13: Lt Governor of JKUT, Manoj Sinha vide Notification No. Srinagar, the 13h of May, 2025. S.O. 12S.- made "Amendments" in "Prison Manual, 2022", copy with CTN which reads as under:-

            "In exercise of the powers conferred by section 59 of the Prisons Act, 1894 and all other powers enabling it in this behalf, the Lieutenant Governor is pleased to direct that the following amendments shall be made in the 'Prison Manual, 2022; namely:-

2. 1. In chapter I, under the heading "Definitions" for clause (14), the following clause shall be substituted; namely:- "(14). Habitual Offender. Habitual offender means a person who during any continuous period of five years, has been convicted and sentenced to imprisonment on more than two occasions on account of any one or more of the offences committed on different occasions and not constituting parts of same transaction, such sentence not having been reversed in appeal or review:

Provided that in computing the continuous period of five years referred to above, any period spent in jail either under sentence of imprisonment or under detention shall not be taken into account." In chapter V under the heading "Custodial Management" after clause 5.63, the following clause shall be added namely:- 13/05/465 "5.64. Prohibition of caste-based discrimination in Prisons and Correctional Institutions:- (i) It shall be strictly ensured that there is no discrimination/ classification/ segregation of prisoners on the basis oftheir caste. (ii) It shall be strictly ensured that there is no discrimination of prisoners in allotment of any duty/work in prisons on the basis of their caste. iii) The provisions of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013 shall have a binding effect even in Prisons and Correctional Institutions. Manual scavenging or hazardous cleaning of a sewer or a septic tank inside a prison shall not be permitted.
