Delay in initiating APRs not a ground for promotion


New Delhi, Feb 03: The Apex Court in P Sivanandi vs Rajeev Kumar has held that the ACRs of an officer form a part of his service record & also held that ACRs could not be ignored for the purpose of his promotion.

The bench set aside a Madras high court order which had held that seelect commettee could not consider ACRs of petitioner for the period 01.04.1993 to 15.07.1993. The court referred to decesion wherein it was held that the prescription of a period for writting an ACR is not mandatory,but directory.

The writting & review of ACR was beond his control & we dont see any rational basis on which petiotiner could be disadventaged merely because his superrior officers were lax in the discharge of their responsibities. 

It is a live example in J&K that an IAS officer is not initiating APRs of one officer despite personal & written requests for which department is not processing his case for promotion. It is also pertinent to mention here that the said IAS officer is at present working as Secretary, CAPD in J&K Govt.
