Jammu, Jan 22: CIC issued show-cause notices to many departments of J&K for non compliance, violations & other matters related to, because it is a public issue that lot of PIOs do not bothered to reply as per requirements by making applicants to file Appeals, which speaks of their incompetence & dereliction of duties?
CTN is is possession of proofs, where applicant has asked for "A" but officers had replied for "B" for the reasons best known to them.
Central Information Commission has issued show-cause notices to Jammu Municipal Corporation Sub-Divisional Magistrate, Tehsildar and other Public Information Officers for non-compliance of the timelines for furnishing information under Right to Information Act & it has cautioned Jammu Municipal Corporation against violating the provisions of the Act.
In a Second Appeal, an applicant approached Sub-Divisional Manager North Jammu seeking information about encroachment on nullah in Lower Muthi area of Jammu. Neither SDM furnished any information not First Appeal was adjudicated by the First Appellate Authority but in turn while disposing off the Second Appeal, the Chief Information Commissioner observed that “no reply has been provided to the appellant within the stipulated time period which is a violation of the provisions of the RTI Act, 2005”.
Accordingly, the Commission has directed PIO-cum-SDM North Jammu to provide a reply in accordance with the provisions of the RTI Act, 2005 and explain as to why penal action should not be taken against him as per Section 20 (1) of the RTI Act, 2005.
Meanwhile, the Central Information Commission has cautioned the Jammu Municipal Corporation against violation of provisions of the RTI Act in future.
The warning note has been issued after it was noticed by the Commission that the PIO furnished that information to the applicant which was exempted from disclosure as per Section 8(1)(j) of the RTI Act.
However, CTN is in possession of continues 04 grievance filed in Govt Grievance Cell for which so called Nodal Officer of Jammu Municipal Corporation has finally disposed in a doubtful manner to Gr no. 999004506884, 999004357670, 999004342552, 999004214684, if enquired wrt grievance filed & disposal shall speak the truth that how grievances are bothered.
