High Court seeks record from FCR, J&K

Jammu, Sept 18: In WP(C) No. 2392/2023 CM No. 5624/2023 titled Mohd. Shafi Bhat Vs UT of J&K and others after hearing  HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDERED as:-

The petitioner herein is in second round of litigation.

The petitioner had earlier petitioned this Court with a writ petition WP(C) no. 3708/2019 which resulted in passing of an order dated 09.10.2019 with a direction to the Financial Commissioner (Revenue), J&K, Jammu to consider and dispose of the revision petition filed by the present petitioner against mutation no. 1177 dated 26.04.2003 passed by the Tehsildar, Ramban and the adjudication was to be done by the Financial Commissioner (Revenue), J&K in accordance with law after hearing all the parties.

Learned counsel for the petitioner submits that the Financial Commissioner (Revenue), J&K has come to decline the revision petition filed by the petitioner on the ground of delay and laches.

Prima facie case is made out.

Issue notice to the respondents.

Petitioner to furnish registered postal covers for the service of the respondents within a period of seven days, whereupon the Registrar Judicial, Jammu to issue notices to the respondents.

Send for the record of File no. 716/FC-AP and 1027/FCAP, 717/FC-AP titled “Mohd. Shafi Bhat Vs Collector Land Acquisition & others” from the office of the Financial Commissioner (Revenue) J&K.
