Srinagar, September 26: In WP(C) No. 2096/2022 CM No.5284/2022 titled Zahid Jeelani Wani Vs. University of Kashmir & Ors. after hearing HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDERED as:-
Impugned in this petition is order of Assistant Registrar, General Administration, University of Kashmir, dated 13th September, 2022, whereby the petitioner, who was appointed as Junior Coordinator on compassionate basis, has been reduced in rank to the post of Junior Assistant.
Impugned order is assailed by the petitioner, primarily, on the ground that before ordering demotion of the petitioner, the petitioner was not afforded any opportunity of being heard, forget about holding of an enquiry required for imposing the major penalty.
Heard Mr. Aqib Aijaz, learned counsel for the petitioner.
Notice in the main writ petition as well as in CM returnable within four weeks.
Requisite steps for service within two weeks.
List along with WP(C) No.2030/2022 on 07.11.2022.
In the meanwhile, subject to objections and till next date of hearing before the Bench, the order impugned dated 13th September, 2022, issued by University of Kashmir, in so far it pertains to the petitioners, shall remain stayed.
The petitioner shall be permitted to perform her duties as Junior Coordinator.
