
Jammu, July 14: In OWP No. 920/2013 IA No. 1271/2013 CM No. 5330/2020 tiltled Raghubir Singh Vs State and ors. after hearing HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER ED as:-
The service of respondent no. 7 has taken place on account of deemed service. There has been no representation on his behalf despite service. Respondent no. 7 is thus set ex parte.
In this writ petition, the petitioner is seeking to save water pond measuring 25 kanals 12 marlas in khasra No. 3891 situated in village Bhalwal, Jammu, which is said to be 100 years old from getting converted for the purpose of construction of a building proposed at the end of the official respondents.
In terms of an order dated 02.07.2013, this Court directed maintenance of status quo and the same is still subsisting.
Considering the fact that this writ petition is pending consideration for the last more than nine years without any reply/objections having been filed by the respondents till date, this Court is constrained to resort to a direction firstly to the respondent no. 3-Divisional Commissioner, Jammu to submit a detailed factual status report along with supporting revenue record about the nature of the land so said to be water pond, measuring 25 kanals 12 marlas in khasra No. 3891 situated in village Bhalwal, Jammu.
Let this status report be submitted by the respondent no. 3-Divisional Commissioner, Jammu within a period of six weeks.
Extension of time for submitting the status report can be sought only upon citing of reasons given by and on behalf of the respondent no. 3.
