JAMMU, Dec 22: Hundreds of Government employees in Jammu and Kashmir may face the prospect of dismissal or demotion as the state High Court has declared the degrees awarded through distance education mode as "invalid".
It is shocking to observe the manner in which the degrees have been conferred on the students.The petitioners, who were before this Court, seeking direction in the name of respondents to give due weightage to their higher qualifications...Indeed want this Court to put its seal on the said illegal act.HHC said in the order passed.Degrees awarded by IGNOU, DOEACC and Maulana Azad National Urdu University`s have been held valid.
In some cases, degrees have been obtained from institutions which are not even recognized by the University Grants Commission, the sources said. Education Department ,Rural Development etc have the maximum number of beneficiaries of these degrees.
While dealing with the matter, the Chief Secretary shall bear in mind the seriousness of the issue and may even go for registration of a criminal case if, in the fitness of things, it is so desired. And on doing so, he shall personally monitor the investigation, the court had ordered.
A communication of Raj Bhawan addressed to Rural Development Department had expedited the process of verification of degrees of the incumbents, who managed illegal promotions as I/C BDO’s. Actions are needed to be taken against the officers, who for vested considerations did it.
It is the talk of the town that incumbents with fraud degree/diploma are ruling over the heads of qualified ones. Degree/Diploma in engineering subjects requires practical trainings otherwise how one will come to know about the matter in original. It is first of to see by the Government whether the concerned official who have obtained degree/diploma through correspondence had sought permission from the competent authority. Thereafter whether due leaves have been sanctioned to appear in the exams/practical, shall bring the scam out immediately. It is also very urgent to see whether the said institution is recognized by AICTE/UGC.
In a notification it was declared that all degrees, diplomas and certificates, including technical education degrees and diplomas awarded through open and distance-learning mode of education by universities established by an Act of Parliament or state legislature, institutions deemed to be universities under Section 3 of the UGC Act and institutions of national importance declared under an Act of Parliament stand automatically recognized for the purpose of employment to the posts and services under the central government, provided they have been approved by the UGC.The notification, however, did not make it clear if these universities can also offer diploma, degree and postgraduate programmes in engineering and technology through distance education.
The UGC had barred universities and other higher-educational institutions from offering diploma, bachelors and postgraduate courses in engineering and technology other than MBA and MCA through distance-learning until further orders. Issuing a public notice in March, the regulator had also warned of action if any institute failed to comply with this directive. The latest notification also does clarify on its implications on state open universities the UGC derecognized in the last few months.
It is well known fact that one Younus Malik, than Special Assistant With Ali Mohd Sagar then Minister, Rural Development Dept. and a big nexus of the officers of the department managed lot of other illegal promotions in RDD. Additional chargewere also assigned to blue eyed why? the reason is of the common sense. One senior most Engineer in the department kept attached since Feburary, 2013 because he did not paid & till date attached by present Government also. RDD preferred to keep the post of SE REW vacant till now since December,2013 just not to promote that Engineer speaks about the working of the department, openly speaks of the corruption.
There are many RDD officials, who had managed diploma/Degree through correspondence illegally & have been promoted from work supervisor to the level of Assistant Executive Engineer, Draftsman to Junior Engineer/Assistant Engineer& shortly one work supervisor appointed in this century may be Executive Engineer. A part of big scandal of Rural Development shall be publicized in the next edition for the information of public to see the corrupt practices of the Department of Rural Development &Panchayti Raj.
There is also a story of fraud promotions/release of grade of Superintending Engineer/Executive Engineer by the RDD openly speaks of vested considerations & RDD is in the watch list of Vigilance Department. MNEREGA scam is also in the eyes of public & vigilance is very shortly going to unearth the scam of job cards to minors, dead & Govt. employees. It is also to mention here that State Vigilance Commission has recently orders departmental actions against one BDO & Village Level Worker in MNEREGA scam.
It is pertinent to mention here that PHE/I&FC has cancelled the promotions made on the off campus correspondence degres from Vinayka Mission University vide Govt. order No. 54 PW(Hyd.) of 2015 dated 20.02.2015. Shall officers of RDD also act in a same way for the fraudees?
