Srinagar, Sep 02: J&K Govt issued "Pre-Termination Notice" to a Govt Teacher, details with CTN read as under"-
Whereas, you applied for station leave permission for visiting abroad (Qatar) w.e.f. 0l.03.2025 to 28.02.2026, which was accordingly submitted to Administrative Department by this Directorate vide letter dated: 06.05.2023, dated: 02.01.2024 and dated: 28.02.2024; and
Whereas, Administrative Department vide letter No.: EduNGK/50/2022-O1 (130081) dated: 28.03.2024 instructed to clarify as to whether- you have proceeded abroad or waiting for grant of permission; and
Whereas, Chief Education Officer, Baramulla vide No: CEO/Bla/Estt/25516 Dated: 15.05.2025 conveyed that you have already left the station to Qatar on Of.03.2025 without waiting for permission from competent authority; and
Whereas, Principal HSS Zaloora (Cluster Head) during his visit to GMS Sagipora, Zone Dangerpora found you un-authorizedly absent from your duties for several years as per records maintained in the school and you have exhausted all kinds of leave entitlements including leave on medical grounds, casual leave, child care leave and commuted leave; and
Whereas, it has further been reported that you rarely report your duties, usually once before declaration of winter vacations; and
Whereas, a three member Enquiry Committee was constituted bY Chief Education Officer, Baramulla vide letter No.: CEO/Bla/IMW/F905/7723-25 dated: 30.03.2026 to conduct a detailed enquiry into the matter; and
Whereas, the enquiry Committee furnished its report vide No.: BHSSD/ll08 Dated: 20.04.2026 wherein it has got established that You have remained absent from your duties for a prolonged period particularly w.e.f. March 2025 till date; and
Whereas, it has further been observed that your conduct as a teacher reflects dereliction of duty and lack of professional responsibility; and
Whereas. the matter was examined in this Directorate and a serious cognizance has been taken of your unauthorized absence and misconduct; and
Whereas remaining un-authorizedly absent from duties attracts action as warranted in terms of Article 128 of J&K Civil Services Regulations, CSR (Volume 1) of 1956, which reads as under:-
"Absence without leave or after the end of leave involves loss of appointment.
Now, therefore, through the medium of this notice, you are hereby given an opportunity to explain as to why action as warranted in terms of Article 128 of J&K Civil Services Rules (Volume 1) of 1956, shall not be initiated against you for remaining unauthorizedly absent from your legitimate duties.
Your reply shall reach this office within a period of 15 days from the date of issuance of the notice, failing which it will be presumed that you have nothing to say in your defence and action as warranted under rules shall be initiated against you accordingly.
