J&K Govt issues "Pre Termination Notice" to a Govt Teacher for un-authorized absence for more than 05 years

Srinagar, May 24: J&K Govt issued "Pre-Termination Notice" to Ms. Preeti Kumari, PMP Teacher, Zone Shangus, Anantnag, details with CTN read as under:-

              Whereas, on being appointed as Teacher under the PM Package in District Cadre Anantnag vide Government Order No. 806-Edu of 2010 dated 24.11.2010, you were subsequently adjusted in Zone Shangus by the Chief Education Officer, Anantnag vide Order No. CEO/ A/Estt-I1/ 17981-18321 dated 01.03.2011, where you performed duties w.e.f 15.12.2010 to 13.06.2015; and

Whereas, pursuant to Order dated 04.06.2015 issued by the Chief Education Officer, Anantnag, you were transferred from Zone Shangus to Zone Qazigund and subsequently relieved from Zone Shangus on 13.06.2015 with directions to report to the Zonal Education Officer, Qazigund for further adjustment; and

Whereas, you represented the department on 03.09.2024 requesting permission to rejoin duties and settlement of the intervening period on the grounds that you were allegedly taken away from your family by certain unscrupulous elements on 13.06.2015 and kept at different places under threat; and

Whereas, this office vide letter  dated 11.09.2024 sought a factual report in the matter from Chief Education Officer, Anantnag, who in response vide letter No. CEO/A/IMW/9589/25 dated 01.02.2025 reported that no such employee was working in Zone Qazigund; and

Whereas, this office again vide letter dated 26.03.2025 directed the Chief Education Officer, Anantnag to conduct an in-depth inquiry into the matter and accordingly the case was enquired through the District Vigilance Officer and Assistant District Vigilance Officer, Anantnag who furnished its report vide communication dated 13.05.2025 duly forwarded by CEO Anantnag vide letter dated 17.05.2025; and

Whereas, the matter was placed before the Designated Committee in its meeting held on 20.08.2025 and upon detailed examination, the Committee recornmended referral of the case to the Administrative Department for termination of services in view of unauthorized absence exceeding nine years & was directed this office to consider the case under the provisions of Article 128 of the Jammu and Kashmir Civil Services Regulations, CSR (Volume-1) of 1956 and initiate further action against the delinquent teacher after following due procedure and recommendations of the designated committee ; and

Whereas, remaining un-authorizedly absent from duties for more than five years attracts action as warranted in terms of Article 113 and Article 128 of J&K Civil Services Regulations, CSR (Volume 1) of 1956, which reads as under:- Article 128 "Absence without leave or after the end of leave involves loss of appointment. "

Now, therefore, through the medium of this notice, you are hereby given an opportunity to explain as to why action as warranted in terms of Article 128 of J&K Civil Services Rules (Volume I) of 1956, shall not be initiated against you for remaining unauthorizedly absent from your legitimate duties.

Your reply shall reach this office within a period of 15 days from the date of issuance of the notice, failing which it will be presumed that you have nothing to say in your defence and action as warranted under rules shall be initiated against you accordingly.
