J&K: CAT seeks "PA" of  Director, Finance to explain what steps taken in light of continuous projection of liabilities over a period of 06 yrs

Jammu, May 03: In O.A./172/2025 (JAMMU) titled GHARA RAM Vs IRRIGATION AND FLOOD CONTROL DEPARTMENT, after hearing CAT ordered as under:-

Pursuant to the last order dated 28.04.2026 passed by this Tribunal, Mr. Manoj Gupta, Chief Engineer, Irrigation & Flood Control Department (Respondent No. 2), appeared virtually before this Court and submitted that the payment in question pertains to the period from 2015 to 2020.

He stated that the said liability has been consistently projected in the budget provisions; however, the disbursement of payment is contingent upon the release of funds by the Finance Department.

It was further submitted that the requisite funds have not been released by the Finance Department to date. He further apprised the Court that a liability amounting to Rs. 606.15 crores has been projected annually for the period from 2021 to 2026.

It was also clarified that the Irrigation and Flood Control Department functions under the Jal Shakti Department (PHE), which manages consolidated funds and is responsible for regulating the allocation and disbursement of funds upon receipt.

In view of the above, the Jal Shakti Department is hereby directed to furnish copies of all official communications addressed to the Finance Department reflecting the annual projection of liabilities for the period 2015 to 2020.

The same shall be provided to Mr. Rajesh Thappa, learned A.A.G., who shall place the documents on record through the Registry for the perusal of this Tribunal.

Further, the Director, Finance Department, is directed to remain personally present before this Court on the next date of hearing and explain what steps have been taken in light of the continuous projection of liabilities over a period of six years.

In the event of non-compliance, the Court shall be constrained to initiate appropriate punitive action against the Director.
