Learned Senior counsel for the appellants submits that under the prevailing Rules (AFO 04/2012) Airmen are required to seek the mandatory prior permission before applying for civil posts and must meet the specific eligibility criteria (e.g., applying for Group A posts after 7 years of regular services).
He submits that respondent No.-1 applied for Group–B post and did so without requisite prior approval.
And, when his discharge was refused, he joined the Civil Services while on leave and did not report back to the Indian Air Force (IAF), leading the Authorities to view him as a deserter.
