J&K: High Court stays "excess Electricity payment bill" generated by JPDCL

Jammu, March 6: In WP (C) No. 531/2026 CM No. 1230/2026 titled M/S Vasudev Constructions, Appellant(s)/Petitioner(s) Through: Mr. Parag Sharma, Advocate. V/s U.T of J&K & Ors. Respondent(s)  after hearing HON’BLE MR. JUSTICE M A CHOWDHARY, JUDGE ORDERED as under:-

 01. Petitioner claiming to be a Proprietorship firm engaged in construction activities and is a bona fide consumer of the respondents under Account No. 5985590000 having a contract demand of 165.778 KVA and sanctioned load of 149.2 KW had been regularly paying electricity bills raised by the respondents and has never defaulted any payments.

02. It is alleged that the respondents have raised “excess demand” charges jumped from a minimum of Rs. 443.80 in October 2025 to a staggering amount of Rs. 67, 977.70 in February 2026 which are clearly reflected in the bills attached; that the respondents have unilaterally shifted the billing methodology by applying a new multiplying factor of 4.131 to the excess demand calculations without any prior inspection, report or notice.

04. Issue notice to the respondents, returnable within a period of four weeks, subject to the filing of requisites within one week.

05. List on 22.05.2026.

06. Meanwhile, subject to objections and till next date of hearing before the Bench, excess payment is stayed and the electricity connection to the petitioner’s unit shall not be disconnected for default of payment of excess amount, however, the petitioner shall make payments as per the bills of consumption of electricity.
