Crime Branch files a chargesheet against a former female Assistant Professor for allegedly concealing foreign nationality to obtain a govt post

Srinagar, Feb 05 ; The Economic Offences Wing of the Crime Branch Jammu and Kashmir today produced a chargesheet against a former Assistant Professor of SKIMS Soura for allegedly concealing her foreign nationality to fraudulently obtain a government post.

It said that the chargesheet in FIR No. 76/2022 was filed before the Court of the Chief Judicial Magistrate, Srinagar, against Ms. Afshan Shabir, wife of Syed Akeel Ahmad, a resident of Shibath Zadibal.

The case centres on the appointment of Ms. Shabir as an Assistant Professor at the prestigious Sher-i-Kashmir Institute of Medical Sciences Soura in 2019.

Investigations revealed that the accused, while applying for the post under Advertisement Notice No. 04 of 2015 as an in-service candidate, submitted a State Subject Certificate and declared herself an Indian citizen and permanent resident of J&K.

However, probe findings allegedly established that Afshan Shabir had acquired British citizenship prior to her government service and was also a holder of an Overseas Citizen of India card, a status that renders an individual ineligible for a government post.

Officials stated that the accused concealed this fact both during the application process and subsequently while in service.

Examination of seized official records, including her service book, personal file, and selection committee minutes, corroborated the allegations.

During the investigation, the accused admitted to holding a British passport and an OCI card, the EOW said.

The probe concluded that by misrepresenting her citizenship status, the accused secured the public post fraudulently, resulting in wrongful gain to herself and a corresponding loss to the state exchequer.

Her services were subsequently terminated by the government vide Order No. 23-SKIMS of 2022 dated August 20, 2022.

Following the culmination of the investigation, the chargesheet under Sections 199 (False statement made in declaration which is by law receivable as evidence) and 420 (Cheating) of the Ranbir Penal Code has been submitted for judicial determination.
