Jammu, Jan 05: In CPSW No. 749/2018 in SWP No. 2375/2014 titled Abdul Latief Wani after hearing HON’BLE MR. JUSTICE JAVED IQBAL WANI, JUDGE ORDERED as under:-
1. In the instant contempt petition, the petitioner has alleged noncompliance of the judgment passed by the Division Bench dated 25.08.2022 in terms whereof, the petitioner was held entitled to the regularisation as Driver retrospectively w.e.f. 26.09.2010 instead of 25.07.2013 and also to the release of all consequential benefits including monetary benefits in his favour.
2. Compliance report has been filed by the respondents on 25.11.2025 accompanying with a consideration order dated 24.11.2025, wherein it is being inter alia stated that pursuant to the judgment of the Division Bench, sanction came to be accorded to the regularisation of the petitioner as Driver retrospectively w.e.f 26.09.2010 instead of 25.07.2013 and all consequential benefits including monetary benefits stand released in favour of the petitioner in furtherance thereof in terms of the Provisions of J&K Civil Services [Special Provisions] Act of 2010, in relaxation of rules.
3. Learned counsel for the petitioner, however, disputes the release of the consequential benefits including the monetary benefits and, in this regard, seeks and is granted three weeks’ time to file response thereto.
