J&K: Court frames charges against fake lecturer

JAMMU, Dec 31: Additional Sessions Judge Doda Archana Charak today framed charges against Arfat Khan, son of late Mohd Aslam of Bulandpur, Doda under Sections 465, 467, 468, 120-B IPC for causing wrongful loss to the exchequer amounting to Rs 46,53,354.00 by impersonating as Government official and preparing fake and forged joining/ transfer/ appointment orders.

Previously, a written complaint was lodged by Anuradha Gupta, the then Director School Education Jammu on 21.11.2019 mentioning that during the scrutiny of transfer/posting orders of Lecturers, School Education Department Jammu has come across the fake and forged transfer/posting orders of accused and others.

On the receipt of complaint, preliminary verification was initiated at Crime Headquarter Jammu and during the course of enquiry the complaint was prima facie proved against Arfat Ahmed, son of late Mohd Aslam of Bulandpur.

Accordingly, a formal case FIR was registered in P/S Crime Branch, Jammu & during the course of investigation, the investigating agency found that Govt orders bearing No. 169-Edu of 2019 dated 22.04.2019, 171-Edu of 2019 dated 23.04.2019, 192-Edu of 2019 dated 30.05.2019 and 178- Edu of 2019 dated 07.05.2019 have been issued by the Administrative Department and relates to delegation of powers, constitution of committees and creation of post respectively and copies of Govt Orders of same numbers as furnished by Crime Branch Jammu have been examined and found that these orders have not been issued by the department and are fake and fictitious.

Investigation also revealed that Arfat Ahmed constructed his fake service book as Arfat Ahmed Khan, son of Mohd Aslam of Dedni Doda and mentioned in the fake service book that he joined Govt Higher Secondary School Basholi (Kathua) on 03-04-2012 as computer lecturer and rendered his services up to 15-05-2017.

Version of the then Principals namely Shiv Dutt Sharma and Pawan Dutt Sharma and CEO Kathua revealed that no such person namely Arfat Ahmed Khan had joined in Higher Secondary School Basholi and got transferred from Kathua district.

Statement of custodian of the service book of Arfat Ahmed Khan namely Farooq Ahmed, Lab Bearer GHSS Jakyas Doda was recorded and he stated that Arfat Ahmed Khan used to keep his service book with him and did not deposit in the office.

By resorting to forged and fraudulent means, the accused managed to withdraw huge amount of Rs 46,53,354.00 from Government.

After hearing “documentary/oral evidences gathered together with all relevant aspects and statement of witnesses have fully established that accused Arfat Ahmed, son of late Mohd Aslam of Bulandpur had cheated the Government and accordingly caused wrongful loss to the exchequer amounting to Rs 46,53,354.00”.
