HC directs J&K Govt to pay Rs  65 Lakh  to Respondents or to face further coercive measure

Jammu, Dec 25: In ROBSW No. 07/2024 in CPSW No. 540/2018 C/w CPSW No. 540/2018 ROBKAR …. Petitioner(s) Vs Sanjeev Verma, Commissioner Secretary to Government General Administration Department Jammu  after hearing HON’BLE MR. JUSTICE JAVED IQBAL WANI, JUDGE ORDERED as under:-

  1. The comprehensive compliance report, filed by the respondents, has been traced out and placed on record, which suggests that the respondents have found the petitioner entitled to an amount of Rs. 65,43,933.00/-, on account of arrears of salary w.e.f December 2015 to March 2025, arrears of salary w.e.f 23.08.2004 up to 06/2009 and cash in-lieu. It is being stated however that a bill for an amount of Rs. 13,38,795.00/- only on account of budgetary limitation has been submitted before the District Treasury, Reasi for it onwards payment to the petitioner.

Learned counsel for the petitioner submits that the aforesaid position manifestly tends to show that the respondents prima facie are not inclined to comply with the judgment, and besides the counsel for the petitioner disputes the calculation of the arrears of salary worked out by the Sr. No. 107 2respondents/contemnors, besides stating that even the amount of Rs.13,38,795.00/- has not been paid to the petitioner till date.

In view of the aforesaid position obtaining in the matter and in order to ensure timely and speedy compliance of the judgment, non compliance of which is complained of in the instant contempt petition, and which judgment has assumed finality on account of dismissal of SLP filed by the respondents/contemnors, the Court is left with no option except to direct the personal appearance of respondent/contemnor Director, Food Civil Supplies and Consumer Affairs Department, Jammu as also the Assistant Director FCS &CA to appear in person in furtherance of the proceedings of the instant contempt petition as well as the Robkar.

The respondents/contemnors in the meantime shall ensure payment of aforesaid amount of Rs.65,43,933.00/- and produce a proof thereof on the next date.


4. A copy of this order shall be furnished to Mr. Adrash Bhagat, appearing counsel for the respondents under the seal and signature of Bench Secretary of this Court today itself for its compliance.

Any violation of the present order shall be viewed seriously and may entail further coercive measure in the Robkar, already framed against the respondents/contemnors.

5. List again on 29.12.2026.
