Jammu, Dec 05: In O.A./1911/2025 (JAMMU) titled ABDUL LATIF KHANDAY Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-
Miscellaneous Application No. 1825 of 2025:- The present M.A. has been filed by the applicants through counsel seeking permission of this Tribunal to join in and pursue Original Application No. 1911 of 2025 together.
For the reasons stated therein, the M.A. is allowed. Original Application Heard.
The grievance of the applicants as projected by the learned counsel for the applicants is that vide impugned Order No. 433 DSEJ of 2025 dated 21.11.2025, the mutual transfer order of the applicants dated 09.07.2025, has been cancelled by the Respondent No. 2, despite the fact that controversy involved in this O.A. is pending before this Tribunal in O.A. No. 1046/2025 & connected O.A.s, wherein, the order dated 14.07.2025 of Respondent No. 2 was stayed by virtue of which the mutual transfer order of the applicants dated 09.07.2025 has been kept in abeyance by the Respondents.
Learned counsel for the applicants submitted that mutual transfer order dated 09.07.2025 in case of applicants has already been implemented as the applicants, after relieving, have joined their new place of posting and are presently continuting their duties.
Issue notices to the Respondents. Mr. Sudesh Magotra, learned A.A.G. appears and accepts notices on behalf of the Respondents.
Learned A.A.G. submitted that in pursuance to the mutual transfer order dated 09.07.2025, several representations were received from various officials seeking withdrawal of their consent for the said mutual transfers, besides few officials have also superannuated and after re-examination of the entire issue by the Director, School Education, Jammu in consultation with the concerned Chief Education officers, the order dated 21.11.2025 has been issued.
Learned counsel for the applicants stated at bar that no representation has been made by the applicants for withdrawal of their mutual transfer order and prayed that case of the applicants be protected.
Having considered the submissions made by both the parties at bar and in view of the facts and circumstances of the case, a case for indulgence of this Tribunal is made out in favour of the applicants.
Accordingly, as an interim measure, till next date of hearing and subject to objections of the other side, the Order No. 433 DSEJ of 2025 dated 21.11.2025 issued by Respondent No. 2, is stayed qua the applicants.
List on 09.12.2025.
