Jammu, Dec 02: In WP (C) No. 3281/2025 CM No. 7487/2025 titled Harpreet Singh V/s UT of J&K & Ors. after hearing HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDERED as under:-
1. By this petition, petitioner herein is seeking a direction upon respondent Nos. 1 to 6, to initiate immediate departmental and legal proceedings against respondent No. 7, Head of Department, Radio-Diagnosis, Government Medical College Jammu for indulging in illegal private practice during official service hours in violation of the Service Rules and Regulations and Government Orders including SRO-132 of 1998, Government Order No, 43-HME of 2013, dated 17.01.2013 and Government Order No. 6L2-JK{HME} of 2022, dated 12-08-2023, issued by the Government of Jammu and Kashmir whereby, private practice by Head of Departments is banned.
2. It is stated that despite being inquiry conducted by a committee of doctors, constituted by Principal and Dean Government Medical College, Jammu and Communication dated 18.10.2025, issued by Director Health Services Jammu to Administrative Secretary, to the extent that conduct of respondent No. 7, was found in violation of Service Rules and Government Order and breach of professional ethics, no disciplinary action has been taken against respondent No. 7.
3. It is stated by the learned counsel for the petitioner that on 28.10.2025, Director Health Services, Jammu has requested respondent No. 1 to intervene and to take action against respondent No. 7.
4. Mr. Raman Sharma, learned AAG was directed to report instructions, he states that the enquiry has been concluded and the enquiry report has been submitted to respondent No. 1 for further necessary action.
