One hot issue pertains to Town Planning Section as Master Plan was notified in March, 2017 , which was thereafter processed for Zonal Plan for more detailing but was not done by the CTP of the time, an illegal act in violation of J&K Development Act of 1970 & in which one "Proposed Road" was reflected in Birpur Area despite big buildings stands constructed in the said proposed road & without building permission of JDA & if on today also enquired the alignment shown as "Proposed road".
This illegal act on the part of CTP/STPs, ATPs etc etc, otherwise would have acted upon but none of the VC since years bother to look into the issue.
For seeking "DEEMED SANCTION" of a BP case, in continuation to letters dtd. 17.07.2024 on VC JDA's mail & hard copy as well, it was again submitted in continuation to their previous submissions through mail & hard copies dtd. 22.05.2022, dtd. 18.07.2022. dtd. 06.02.2023, dtd. 16.05.2024 and dtd. 17.7.2024 that once upon a time they applied for a Building Permission case on a spot, nearby which lot of illegal constructions were allowed without Building Permission clearance by JDA in so called proposed roads & Public Utility land use, which can easily be verified from Master Plan & year wise details in google?
It is to mention here that one BP case was rejected by one of incompetent CTP of time, Jagdish Hans & his team vide No. CTP/JDA/BPC/1039-41 dtd. 02.02.2021 on the terms, which nowhere exits in Jammu Master Plan 2032, which can even on today can be verified from the STP of JDA.
Thereafter after complaints by applicant, then VC Pankaj Mangotra sought comments from CTP, Town Planning Organization over the illegal observations of CTP, JDA & he in turn vide No CTPJ/JMP/2021-22/1774 dtd. 09.03.2022 clarified that observations of CTP of JDA are different but then VC prefer to sleep over the issue because CTP & VC worked together at young age in TPO, following which a complaint was filed against VC & CTP to then Pr Secretary, H&UDD, Sh Deeraj Gupta.
Pr. Secretary by understanding the issue sought a detailed report from then VC over the issue following which then VC vide No JDA/CTP/000176/388 Dtd 1.10.2022 agreed that observations of CTP of JDA are not matching with Master Plan but also wrote that said BP case cannot be considered because a “Proposed Road passes through the said plot” but no actions was taken on CTP & his team for wrong rejection of BP Case, raised some questions.
Now, strange to write that said so called “Proposed Road” has neither been notified by JDA nor taken up despite issuance of Jammu Master Plan on 17th March 2017, hence it is proved case of harassment to innocents for clearances of BP cases but boosting illegal constructions.
However, Law speaks if Govt Don't notify the issues like "Proposed Roads" in 06 months after issuance of Master Plan, the said part be revised after Notice but in the said case if some high level enquiry team of of some competent officers shall find a case of harassment by JDA as still today JDA did not consider the said case as Deemed Sanctioned" It reads in Section 50, sub section (1).snapshot as under, which prove malafidies of JDA Officers, needed to be acted upon.
It is further to publish that present Commissioner, H&UDD, Mandeep Kour on a complaint, year back called then VC, Bhawani Rakwal & present STP, Ravinder & complainant, Rajesh Gupta in her office over the said issue of illegal rejection of said BP case ON Proposed Road, then VC & same STP on today were asked to clear the issue of BP case as proposed roads has gone but thereafter VC was transferred, charge of STP was withdrawn, the case went to dustbin as usual due to incompetent team in STP section.
Now, it is needed to see that what present VC JDA & the same STP, Ravinder, who was in the meeting of Comm/Secy, H&UDD in her office & was cleared regarding "Proposed Roads" ? However, Ravinder, STP has been provided with Section 50 & complaint forwarded by LG Office to Comm/Secy, H&UDD over the said issue on which meeting was called by COMM/SECY, H&UDD year back & Ravinder, STP was present in the said meeting.
If enquired, it shall detect a big scam of allowing illegal constructions in so called "Proposed Roads" of JDA but innocents, who wanted to pay Building Permission fee to Govt to Lakh, their BP cases have been put on put on hold by this way or the other by team of Town Planning Sections, otherwise it was their duty to rectify the illegal facts by studying Section 50, as under, needed to be acted upon such incompetent officer & needed to be chopped off to bring more efficiency in the administration.
However, below snapshots speaks about harassment by JDA, by seeing constriction in their so called "Proposed Roads" since years but till day they are not able to rectify the defect in Master Plan.
