JDA's Appointment Scam in Jammu:  Need of Enquiry by BOD/VC?

Jammu, Sep 13: Everyone is aware of the working of Jammu Development Authority in various issues of delay in deciding public issues for years by this way or the other causing harassment to general public.

However, vested considerations on the part of then VCs & concerned officers including Board Members can be observed from illegal regularizations in  violation of terms & conditions of Contractual Appointments, needed to enquired by a high level committee to detect the said scam.

It is to mention here that once upon a time vide order dtd. 18.10.2006 JDA issued a notice for appointment of Legal Assistants on "Contractual Basis" with consolidated salary of "Rs 7000 PM" and selection shall be made for one year only subject to further extension and subject to their performance and the selected candidates "Will not claim to permanent employment in the organization" and one Avinash Gupta was appointed vide order No. 124- JDAOF 2007 dtd 11.01.2007 along above term and conditions.

But he was continued by various extensions in violation of terms and notification and JDA did not bother to advertise for regular and permanent Legal Assistants, if they were required for job raised some questions on concerned VCs for granting extensions?

Thereafter, VC of the time put up his case in agenda of Board Meeting for regularization in violations of terms and condition of first appointment raised some more questions on concerned boss but board only approved increase in salary by 1000 and directed to put up in next BOD meeting.

In 70th meeting of the Board of Directors of Jammu Development Authority held in the year 2010, the services of the petitioners as Legal Assistants were approved for regularization, pursuant whereto, order No. JDA of 47/2011 dated 28.02.2011 was issue by JDA, wherein it was provided that the services of the petitioners are ordered to be regularized and time scale of pay was released in their favour.

This, however, was made subject to ratification by the Board of Directors of the JDA in its next meeting.

After the introduction of the Human Resources Management System, all the employees of the Government as well as autonomous bodies, were required to upload their engagement orders and qualification certificates on HRMS portal. This was to be done in compliance to the notification issued by the Government in this regard.

Following Mr Gupta was to have uploaded his documents on the said portal in the month of November, 2022 but his data was not uploaded by JDA itself being doubtful appointment, so his salaries were not being released with effect from December, 2022 onwards.

JDA said that the Board has only noted the action taken and the issue of ratification of order of JDA for regularization of services of the petitioners has not received formal ratification by the Board?

Govt has also informed Vice Chairman, JDA that legality of appointments of the Mr Gupta is under examination with the Government and in view of the advice of the Administrative Department, the salary of the petitioners is not being drawn.

It is to mention here that once upon a time in 84th Board Meeting of Jammu Development Authority held on  17.11. 2020 some Decisions were taken, which were being processed at the choice of concerned Vice Chairman of the time & among all was the regularization and/or higher placement of Contractual/Consolidated appointed Legal Assistants, who were appointed around more than 10 years back may have also included.

However, the process was carried on but H&UDD vide letter dtd. 03.08.2023 told VC JDA in reference to WPs filed by Avinash Gupta that “The legality of appointment of Mr Gupta is under examination with Govt and prima facie, the appointment appears illegal”?

Now, Vice Chairmen of Jammu Dev Authority of the time wef 17.11. 2020 to 20 .12-2024, who did not bother to issue the Regularization/promotion orders of Legal Assistants & others despite Boards Approval after VC’s recommendations as till then  ratification of order was not done?

But, one, fine morning on 21.12.2024, the so called Department promotion  Committee for Gazetted Cadre of JDA woke up and Promoted some other officers & the said Legal Assistant as Assistant Legal Remembrance with immediate effect but why they were sleeping since 17.11.2020 is a question on concerned & to enquire whether Recruitment Rules of JDA has notified the said post? Whether said post is in Recruitment Rules of JDA are some more questions, which are needed to be enquired to detect the said scam.

H&UDD should verify that when 
 H&UDD vide letter dtd. 03.08.2023 telling VC JDA that “The legality of appointment of Mr Gupta is under examination with Govt and prima facie, the appointment appears illegal”? so how DPC cleared promotion by considering his appointment legal after 16 months of its illegality are some more questions & boss of H&UDD, needed to be enquired?

Now, it is a matter of high level enquiry on the so called Department promotion  Committee of Gazetted Cadre of JDA,  as if JDA was itself contesting the case along with even Contempt Proceedings against the appointment of Legal Assistant & even JDA was not releasing his salaries to Legal Assistant, then how, immediately a team of Officers of JDA called Department promotion  Committee for promotions of Gazetted Cadre of JDA &  promoted the Legal Assistant on Gazetted Cadre along with some others, which posts are not in the Recruitment Rules of JDA raised some questions of doubtful Integrity on such Officers, needed to be acted upon? 

Now, it is the need of the day to look into all previous higher placements in Jammu Development Authority since last 15 years without Recruitment Rules/ designated post to detect the  higher placement scam by adopting
"Pick & Choose" in Jammu development Authority also promotions delayed & thereafter made as per 84th BoDs approvals along with continuation of more consolidated or contractual in JDA since years, so that they can be regularized or fired.
