SRINAGAR, July 18: A court of 1st Additional District Judge Srinagar presided over by Anjum Ara directed for initiation of departmental enquiry against the Investigating Officer for botched up investigation in a murder case and acquitted the accused of murder and directed his release.
A challan was produced by the Police Station Lal Bazar for murder of a woman in 2017 allegedly committed by the accused-Shiraz Ahmad Ellahi of Chadoora, Budgam.
The court has made the prosecution investigation as doubtful by observing that the chain of evidence is incomplete and leaves sufficient and reasonable doubts as to whether the alleged acts have been done by the accused persons.
In this regard, the court directed for forwarding the judgment to Inspector General of Police Kashmir for initiation of departmental enquiry against the IO for zeroing the investigation against the challaned accused persons without obtaining the sufficient, complete and necessary evidence and by not investigating the role of other suspects and the present accused persons in the case in a proper and professional manner.
The court has also acquitted the other accused Ashiq Hussain Ganai of Dralgam, Budgam in the case from the charges of receiving and retaining the stolen property which was stolen from the deceased house at the time of her murder.
The prosecution evidence has neither quality nor credibility and is insufficient to prove the guilt of the accused beyond any reasonable doubt.
Therefore, the serious doubt has been raised over the prosecution story, the benefit of which in light of the set principles will definitely goes in favour of the accused persons facing the trial in the case.
