Jammu, July 7: In O.A./928/2025 (JAMMU) titled VIJAY KUMAR VERMA Vs GEOLOGY AND MINING DEPARTMENT CAT ordered as under:-
Heard. Learned counsel for the applicant submitted that applicant was appointed on compassionate grounds as Orderly in District Jammu under SRO-43 of 1994, in lieu of his father, who died in harness and thereafter, the applicant was continuously discharging his dutis.
It is the grievance of the applicant that vide order dated 27.06.2025 issued by respondent no. 2, he has been deployed from the office of District Mineral Officer, Jammu to the office of District Mineral Officer, Doda.
It is further submitted by the learned counsel for the applicant that the impugned transfer order, though styled as a deployment order, issued by respondent no. 2 is not sustainable as the same has been passed in violation of J&K Civil Services Decentralization and Recruitment Rules, 2010, wherein, the post of orderly belongs to the District Cadre and and is transferable only within his own cadre and in no case the applicant can be transferred to another District Cadre.
Learned counsel further submitted that the applicant is suffering from Tuberculosis and is under the constant treatment of the doctors in the Chest Disease Hospital, GMC, Jammu and transferring the applicant under these circumstances to District Doda is harsh.
Concluding his arguments, learned counsel prayed that the order dated 27.06.2025 may kindly be stayed.
Issue notices to the respondents. Mr. Rajesh Thapa, learned A.A.G. appears and accepts notices on behalf of the respondents. Learned A.A.G. prays for and is granted four weeks time to file the reply.

Meanwhile, as an interim measure, status quo as on today shall be maintained.
