Jammu, June 14: In T.A./8028/2020 (JAMMU) SWP/WP NO. 649/2020 titled SAMREENA SAYDA Vs D/O HEALTH AND MEDICAL EDUCATION UT OF JAMMU & KASHMIR after hearing CAT ordered as :-
Vide order dated 09.02.2024, the respondents were granted a last and final opportunity to file a reply, failing which the Erring Officer was directed to remain present on the next date of hearing.
Subsequently, the matter was listed on 23.04.2024. However, neither was the reply filed nor was the erring officer present to explain the failure to do so. Thereafter, on 13.06.2024, the reply was still not filed.
On that date, Mr. Sudesh Magotra, learned A.A.G., submitted that the reply would be filed during the course of the day.
However, no reply has been filed even till date. In view of the above, the Court is constrained to direct that the salary of respondent No. 3 – Under Secretary to Government, Health & Medical Education Department, Jammu and Kashmir – be stopped with immediate effect until further orders.
The concerned Drawing and Disbursing Officer (D.D.O.) shall ensure compliance with this direction forthwith. List on 21.07.2025
