JAMMU, June 2: Special Judge CBI Srinagar Adnan Syed today awarded three years imprisonment to Sub-Post Master and agent for misappropriation of deposits in Post Office Bandipora.
One, Ghulam Qadir Lone, Sub-Post Master and Mohammad Shafi Lone (Small Authorize Saving Agent No. 1542) during the year 2008-2009 dishonestly and fraudulently entered into criminal conspiracy with each other with a view to cheat the Post Office Bandipora and public at large by way of misappropriating the deposits received from various private persons for investment in term deposit and other saving schemes.
In pursuance of criminal conspiracy, they issued either fake pass books or deposited less amount against the depositors names in the Post Office Bandipora records.
The accused persons instead of depositing the money in full in the Post Office dishonestly and fraudulently misappropriated the same for their own use.
After hearing both the sides, the court observed that from the oral as well as documentary evidence, prosecution has succeeded in proving beyond all reasonable doubts that accused Ghulam Qadir Lone, Sub Post Master and accused Mohammad Shafi Lone, Small Authorized Saving Agent misappropriated deposits received in Post Office Bandipora.
As such Ghulam Qadir Lone Sub Post Master has committed criminal misconduct which is punishable under Section 5 (1)(c) & (d) read with 5 (2) J&K Prevention of Corruption Act read with Sections 120-B and 409, 420, 467, 468, 471 & 477-A RPC and accordingly he is convicted for all these sections”, the court said, adding that Mohammad Shafi Lone has committed offences under Sections 120-B and 409, 420, 467, 468, 471 & 477-A RPC as such he is also convicted.
The court further observed that prosecution has not established that accused persons are habitual offenders or have been convicted earlier although while advancing arguments. Public Prosecutor for the CBI has stated that first accused has earlier been convicted in one case by this court but has not supported his arguments with any record of this court.
Accordingly, court awarded three years simple imprisonment to both the accused.
