Jammu, May 20: In WP(C) No. 1221/2025 CM No. 2903/2025 titled M/S Safa Stone Crusher Vs UT of J&K and Ors. after hearing Advocate Parag Sharma, HON’BLE MR. JUSTICE MOHD. YOUSUF WANI, JUDGE ORDERED as under:-
1. Issue notice to the respondents in the main petition as well as in the interim application, returnable within a period of four weeks, subject to taking of requisite steps for service within a week’s period, for filing of reply/objections, if any.
2. Heard the learned counsel for the petitioner in respect of his prayer for grant of interim relief.
3. It was inter alia contended by the learned counsel that the Government of Jammu and Kashmir Department of Geology and Mining has opened an online portal/G2B2C Portal http://geologymining.jk.gov.in launched on 24.08.2022 for the sale of minor minerals at notified rates for convenience of the general public and for issuance of e-challans.
That the petitioner in order to procure the raw material has to make access to the said portal and the consumers/public for the purchase of the building material have to also visit the same website for placing their orders.
That unfortunately, the respondents’ Department has not given access to the petitioner on its portal which has badly incapacitated him to procure the requisite raw material from the License/Quarry holders.
4. The learned counsel further contended that even the general public/consumers are not also in a position to purchase the building material from the petitioner for want of enlistment of his stone crusher on the official web portal.
5. Perused the interim application supported with an affidavit.
Also perused the main petition and the copies of the documents enclosed with the same as annexures thereto.
6. List on 29.07.2025.
7. In the meantime, subject to any vacation/modification upon the consideration of objections/arguments and till the next date of hearing before the bench, the respondents are directed to enlist the petitioner’s stone crusher in their online official web portal and to provide him access to the said portal for procurement of raw material and corresponding access also to the general public/consumers for facilitating the sale of the building material/minor mineral by the petitioner’s stone crusher.
