Srinagar, May 14: In C.P./106/2024 (SRINAGAR) [ CONTEMPT ] In O.A./281/2024 titled TAHIR ZULLAH MIR AND ORS Vs FOREST ENVIRONMENT AND ECOLOGY DEPARTMENT after hearing CAT ordered as under:-
1. Learned counsel for of the parties are present.
2. The learned counsel appearing for applicant submits that the respondents have filed compliance affidavit. However, the respondents have taken two different stands in complying the orders passed by this Tribunal. In one set of matter, the respondents have considered the cases of the applicants subject to the outcome of the O.A and in the instant case the claim of the applicant was not considered. Learned counsel for the applicant has submitted that the applicant is discriminated by the respondents.
3. The learned counsel appearing for respondents submits that since SLP is pending , as such, at this stage no such order can be passed in the instant matter.
4. Mr. Satinder Singh, AAG, appearing for respondents seeks and is granted four weeks last opportunity to file supplementary affidavit to clear the two different stands taken by the respondents, failing which Commissioner/Secretary Forest Environment and Ecology Department shall remain present in person before this Tribunal on the next date of hearing.
