Jammu, May 10: In O.A./565/2025 (JAMMU) titled BILAL MUSTAFA MALIK Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-
Mr. F.S. Butt, ld. counsel for applicant submitted that the applicant in the present O.A. is aggrieved of impugned Govt. Order No. CEO/K/Legal/2025/1964-71 dated 26.04.2025 passed by the Chief Education Officer, Kishtwar, whereby the case of the applicant pursuant to order dated 17.04.2025 passed by this Tribunal in O.A. No. 443 of 2025 has been illegally and arbitrarily rejected.
The applicant is also aggrieved of impugned order no. ZEO/M/2025/73-79 dated 15.04.2025 issued by ZEO Marwah whereby the applicant is repatriated to his original place of posting.
2. Learned counsel for the applicant prays for interim relief that the operation of impugned Govt. Order No. CEO/K/Legal/2025/1964-71 dated 26.04.2025 and impugned order no. ZEO/M/2025/73-79 dated 15.04.2025 may kindly be stayed in the interest of justice.
3. Issue notice to the respondents. Mr. Sudesh Magotra, ld. AAG appears and accepts notices on behalf of the respondents.
4. Ld. AAG vehemently opposed the prayer of learned counsel for the applicant.
5. Heard learned counsel for the parties.
6. In view of the submission made by learned counsel for the applicant, we are of the view that the applicant has made out a, prima facie, case for interim relief.
7. Accordingly, as an interim measure the Govt. Order No. CEO/K/Legal/2025/1964-71 dated 26.04.2025 and impugned order no. ZEO/M/2025/73-79 dated 15.04.2025 are stayed till the next date of hearing.
8. The respondents are directed to file reply by the next date of hearing.
9. List this case on 05.06.2025.
10. In the meantime, the applicant is permitted to work in Govt. Middle School, Deharie Zone Marwah.
