Jammu, May 04: In OWP No. 451/2007 titled Shashi Mangal Durani Vs State & ors after hearing a bench of HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDERED as under:-
1. Heard in part.
2. When Mr. Rahul Pant, learned Senior counsel assisted by Mr. Anirudh Sharma, Advocate was called upon to address submissions on behalf of the respondents No. 6(a) to 6(c), who were the legal representatives of the deceased respondent No. 6-Mohd. Amin Malik, it came to be referred that on behalf of the respondents No. 6(a) to 6(c), reply to the writ petition has been filed.
However, upon perusal of the digital file as well as the physical file, this Court has not come across with the reply so filed and referred by Mr. Rahul Pant, learned Senior counsel, copy whereof has been shared with this Court from his record which reflects that filing of the reply perhaps has taken place through e-Seva Kendra Counter by reference to date 28.09.2023.
3. In addition, with respect to the respondents No. 4(a) to 4(l), who were the legal representatives of the deceasedrespondent No. 4-Mst. Mymona, there is no clarity as to whether Mr. Anirudh Sharma, Advocate, representing respondents No. 6(a) to 6(c), would represent the respondents to 4(a) to 4(l).
4. Mr. Anirudh Sharma, Advocate submits that he would seek instructions from the respondents No. 4(a) to 4(l) to enter appearance.
5. Registry is directed to trace the reply filed by the respondents No. 6(a) to 6(c) and place it on record, both in terms of physical file as well as the digital file.
6. In the meantime, send for the record of file No. 105/FC-AP of 2006 titled “Bashir Ahmad Dar Vs. State & ors” disposed of vide order dated 21.02.2007.
7. Financial Commissioner (Revenue) J&K, Jammu is directed to ensure that upon receipt of notice from Registrar Judicial, Jammu with respect to the requisition of the above-referred record, the same be submitted to this Court by or before the next date of hearing.
8. List for continuation on 22.05.2025.
