Jammu, Aug 05: In M.A./680/2024 (JAMMU) In O.A./717/2020 titled HEALTH AND MEDICAL EDUCATION UT OF JAMMU & KASHMIR Vs SUNIL KUMAR after hearing CAT Bench orderdd as under:-
M.A. No. 680/2024 and M.A. No. 681/2024 M.A. No. 680 of 2024 has been filed by the respondent's counsel on behalf of Director, Health Services, Jammu for modification of order dated 18.07.2024 passed in O.A. No. 717 of 2020 by virtue of which directions were issued with regard to enquiry agains the respondent no. 3 i.e. Dr. Suleman Choudhary.
Mr. Sudesh Magotra, learned A.A.G. submitted that Dr. Suleman Choudhary against whom the enquiry has been ordered is now no more Principal, Govt. Medical College, Kathua as he has retired on superannuation on 30.06.2020 and presently the post of Principle Govt. Medical College, Kathua is held by Dr. Surinder Attri.
Mr. Sudesh Magotra, learned A.A.G. submitted that reply in this case has now been filed and the answering respondents has highest regard and respect for orders of this Tribunal, and prayed that the order dated 18.07.2024 may now be recalled.
For the reasons stated therein the M.A. is allowed.
Accordingly, the order dated 18.07.2024 is hereby recalled as the reply in this case has been filed and the respondent no. 3 against whom the enquiry was to be initiated has retired from services.
The D.D.O. concerned is directed to release the salary of Principal, Govt. Medical College, Kathua, in case it has been stopped.
O.A. No. 717 of 2020 Reply stands filed. Rejoinder, if any, shall be filed within four weeks.
