CAT seeks "Personal Appearance" of Add. Chief Secretary for non compliance in J&K

Jammu, June 16: In T.A./2149/2020 With M.A./554/2024  titled ASHWANI KUMAR Vs MR SHALEEN KABRA, IAS & ANRS after hearing CAT ordered as under:-

M.A. No. 554 of 2024 filed by the applicants for impleadment of new incumbents is allowed for the reasons stated there in the M.A.

Necessary corrections shall be made in the Index. Mr. Hunar Gupta, learned DAG has failed to produce any interim order from the Hon'ble Supreme Court and nor the judgment dated 26.03.2021 passed by this Tribunal has been implemented.

As per direction given by the Hon'ble High Court vide judgment dated 21.12.2023, the respondents were directed to conclude the selection process positively within a period of three months from the date of the judgment.

It was also observed in the last para that most of the candidates-respondents therein have crossed the age bar and have no scope to get another job as the posts were advertised in the year 2005.

However, now almost three months have also passed after the deadline fixed by the Hon'ble High Court, but the judgment is not implemented and also the order of this Tribunal has not been implemented.

The act of the respondents, not only has caused hardship to them, but also non implementation of the order dated 26.03.2021 of this Tribunal, Ex-facie amounts to contempt on the part of the respondents.

In these circumstances, we are left with no option but to seek appearance of respondent no. 1 before this Tribunal through Virtual mode on the next date of hearing at 1:00 PM with his explanation with regard to the non implementation of the order of this Tribunal dated 26.03.2021.
