J&K: After Advocate Parag Sharma's submissions, High Court orders Govt not permit respondent Nos. 8 and 9 to extract any minor minerals from blocks

Jammu, April 26: In  WP(C) No. 893/2024 CM No. 2185/2024 titled M/s Choudhary Power Project Pvt. Ltd. Th. Nagar Singh Vs UT of J&K after hearing the submissions made by Parag Sharma Advocate over  HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE ORDER 24.04.2024

1. Mr. Parag Sharma, learned counsel for the petitioner submits that the controversy involved in the present writ petition is identical as in WP(C) No. 498/2024 and the Co-ordinate Bench of this Court after hearing the learned counsel for the respondents had passed order dated 15.03.2024.

2. Notice.

3. Mr. KDS Kotwal, learned Dy. AG waives notice on behalf of the respondents. He also submits that the controversy involved in the present petition is identical in nature as in WP(C) No. 498/2024. He seeks time to file response. Response be filed positively by next date of hearing.

4. List along with WP(C) No. 498/2024 on 10.05.2024.

5. In the meanwhile, the official respondents shall not permit respondent Nos. 8 and 9 to extract any minor minerals from the blocks in respect of which mining lease has been granted to the petitioner.

It is further directed that the official respondents shall not allow respondent Nos. 8 and 9 to extract minor minerals in terms of the impugned short term permits unless  the said respondents adhere to all the conditions mentioned in the permit including the SPOs annexed to office memorandum dated 8th August 2022 issued by Govt. of India, Ministry of
Environment, Forest and Climate Change, as also the orders passed by the Supreme Court and the NGT.

Pertinent to mention here that name of Respondent No 08 appears in the list of
