Jammu, Sept 20: In SWP No. 1837/2010 c/w SWP No. 2038/2010 titled Neelam Devi V/s State of J&K and others after hearing HON’BLE MRS. JUSTICE SINDHU SHARMA, JUDGE ORDERED as:-
20.09.2023 01. The contention of the petitioner is that the respondents have engaged private respondent No. 3/Rito Devi as an Angwari Helper in Anganwari Centre Chaklikot Ward No. 5, in ICDS Project Arnas, District Reasi, where the petitioner was selected pursuant to Advertisement Notice No. DIP/J-7372/09.
The petitioner further submits that he figured at Serial No. 50 of the select list issued by respondent No. 2, vide its Order No. DIP/J-8043 dated 23.01.2010.

The private respondent No. 3, in her objections, has submitted that the petitioner has enclosed with her application form, the invalid certificate of BPL category, and mislead the members of the Selection Committee and the same fact, on investigation was found correct and, accordingly, the BPL certificate as well as her provisional selection was cancelled.
Thus, the respondents cancelled the selection of the petitioner and engaged respondent No. 3,who also applied for the said post pursuant to Advertisement Notice No. DIP/J-7372/09.
The respondents are directed to produce the record pertaining to selection for the post of Anganwari Helpers in Anganwari Centre Chaklikot Ward No. 5, in ICDS Project Arnas, District Reasi and also the record pertaining to selection of Angawari Helpers for Anganwari Centre Hudda (Ward No. 6), Sarthalkote in ICDS Project Arnas, District Reasi within a period of two weeks, failing which, respondent No. 2 shall appear in person on the next date of hearing.
