High Court seeks details of business without sanctioned Plans/Parking from Jammu Municipal Corporation

Jammu, August 22: In OWP No. 122/2002. titled Adm. Jammu Municipality and anr. Vs Surat Singh and anr.after hearing  HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDERED as:-

1. During the proceedings, it has come to fore that pursuant to information dated 20.05.2017 provided by Jammu Municipality Corporation under Right to Information Act (RTI for short), there are many hotels, which do not have parking space and yet no action has been taken by the respondents.

According to the said information, which has been disputed by learned counsel for the petitioner, there are more than 160 hotels, which do not have any parking space, besides there are many business/commercial establishments which include banquet halls/ tuition centers/commercial establishments, which too, do not have any parking space is a cause of concern of traffic hazards within the Municipal limits of Jammu.

Petitioner has also placed on record the list of various hotels which had absolutely no sanction plan and no parking space but no action has been initiated against such hotels by the respondents.

2. With a view to proceed further in the matter, it would be apt to direct Mr. Rahul Pant, learned Sr. counsel appearing for the respondents to file a supplementary affidavit in this regard highlighting:
i. the details of all such hotels which do not have parking space;
ii. the details of such hotels which do not have sanction plan;
iii. the details of such hotels which do not have any parking space or sanction plan, but no action has been taken against such hotels;
and iv. the details of list of business/commercial establishments/ banquet halls/tuition centres, which do not have any parking space available at their premises and whether any action has been taken against such establishments by the respondents.


3. Mr. Pant shall file the supplementary affidavit in the manner indicated above by providing the requisite information within one week with a copy in advance to Mr. S.S. Nanda, learned Sr. AAG, who shall file his response to the same within one week thereafter positively.

4. List for continuation on 11.09.2023.
