High Court J&K restricts from recovering any excess amount charged by Schools till next date


Srinagar, September 25: In WP(C) No.2095 titled Delhi Public Schhool Vs. Government of J&K and others. after hearing HON’BLE THE CHIEF JUSTICE HON’BLE MS. JUSTICE SINDHU SHARMA, JUDGE

The challenge in this petition is to the orders of the Fee Fixation Committee dated 01.11.2021 and 25.08.2022.

The argument is that the schools were permitted to enhance the transportation fee by 12% by the Fee Fixation Committee but the said order was stayed in general and, therefore, the petitioner was not charging the transportation fee beyond the actual basis.

It is further stated that in respect of the annual fee, the petitioner was earlier charging Rs. 5000/- and had moved an application for enhancement but the Fee Fixation Committee instead of enhancing it reduced it that too without taking into consideration the factors provided under the Jammu & Kashmir Private Schools (Fixation, Determination and Regulation of Fee) Rules, 2022.

The petitioner has applied for review on 29.11.2021 and the same is pending. The Fee Fixation Committee thus illegally ordered for refund of the excess transportation fee and annual fee.

Issue notice to the respondents and list the writ petition on 15th November, 2022.

Until further orders from this Court, the respondents are restrained from recovering any amount from the petitioner pursuant to the order dated 25.08.2022.
