Failing to file response Transport Commissioner to appear in person: HC

Srinagar, August 16: In CPSW No. 784/2014  titled Abdul Rashid Bhatti Vs Mr. Hardesh Kumar Singh Commissioner Secy. to Govt. Transport Dept. & Another  after hearing HON’BLE MS JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDERED as:-

              On 01.07.2022, Ms. Insha Rashid, learned GA, had submitted that the case of the petitioner is under active consideration before the Finance Department and had sought time to file compliance of the judgment dated 19.11.2013.

The time sought for was granted, however, it was provided that respondent No. 2-Transport Commissioner, J&K, Srinagar, had to appear before the Court along with record, in case the compliance is not filed. Mr. Mubashir Jan, Assistant Commissioner Transport Department has appeared on behalf of respondent No.2- Transport Commissioner, J&K, Srinagar, who could not appear before this Court as he is stated to be on leave today.

Mr. Mubashir Jan, undertakes to file compliance within week’s time. Today Ms. Insha Rashid, learned GA, submits that she has drafted compliance in terms of order dated 01.07.2022 seeks and is granted week’s time for filing, the same before the Registry of this Court, failing which respondent No. 2-Transport Commissioner, J&K, Srinagar, shall remain present before the Court along with record on the next date of hearing.

List for consideration on 17.08.2022. Registry to convey this order to respondent No. 2-Transport Commissioner, J&K, Srinagar, for compliance.
