No response filed in Court since 11 years by J&K Officers

Jammu, September 21:  In the HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU in OWP No. 625/2010 IA No. 864/2010 titled Guru Dass v/s VC, Jammu Development Authority and another after hearing HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE ORDERED as:

The present petition has been filed by the petitioners for quashing the communication dated JDA/RHC/137 dated 23.04.2010 by virtue of which the claim of the petitioner as legal heir being the brother of deceased namely Bua Ditta for allotment of shop at Rail Head Complex, Jammu has been rejected and further prayer is made to direct the respondents to reconsider the case of the petitioner for allotment of shop No. 50 situated at Rail Head Complex, Jammu.

The present petition has remained pending for eleven long years and till date, no response has been filed by the respondents.

No fruitful purpose shall be served in keeping the present petition pending further.

In view of this, this Court deems it proper to dispose of the present petition with a direction to the respondents to consider the claim of the petitioner as legal heir being the brother of the deceased namely Bua Ditta for the purpose of allotment of shop in question under rules in vogue.

Needful shall be done within in a period of three months from the date copy of this order is supplied by the petitioner to the respondents.
