Jammu, June 21: One building, exists, which does not create any traffic or any kind of noise or pollution hazards in the area like some other concerns as being operated as Make Up Academy followed by no any nearby has any objection over the issue because there is no any house upto 300 to 400 metre down side followed by 150 to 200 metre upside left side followed by nallah in back side.
Then also again an individual notice was issued vide No. JMC/CEO/147 dated: 21.06.2021 on the complaint of a gang headed by one rtd. KAS Officer turned black mailer, who is looking to mint bucks from the owner despite having hundreds of commercial shops on the said road including banks, big shopping showrooms etc etc in first filed a RTI followed by a complaint in Govt Grievance cell in Housing Board only regarding the concern leaving all other untouched, proof of which is in owners possession.
Pertinent to mention here that now it has been come to understand that the same blackmailer after not getting any consideration from that concern filed a complaint in JMC on 24th April, 2021 for appropriate actions following which above said notice has been issued to the owner.
Pertinent to mention here that JMC Officer without observing intentially that JMC/Housing Board had already issued a notice to the concern of Channni Himmat as well as more than other 200 concerns in Channi Himmat in one go in newspaper on 10-01-2020/07.01.2020 & being a law abiding citizen of India owner replied JMC on 11-01-2020 with due receipt no. 722 dtd. 11.01.2020 followed by receipt no. 7702 dtd. 22.01.2020, with the request that if as per rules, the business does not under uses permitted, shall close the concern.
However, thereafter, concerned submitted a representation on behalf of all to Pr Secretary, H&UDD on 16.01.2020 for uniform policy in all the housing colonies or to close all concerns & by understanding the issue, Pr Secretary, H&UDD, while enclosing my representation communicated to Commissioner, JMC & MD, J&K Housing Board for comments vide even number dated: 24.01.2020 followed by reminder dated: 07.02.2020 & others.
JMC followed by the reply of Housing Board vide letter dated: 01-07-2020 informed the Govt vide no. JMC/estt/S/01-02 dated. 1.07.2020 regarding the facts of the issue but without waiting for the general outcome for all, only owner was choosed for notice?
It is also to inform that Govt in compliance to PIL No 05/2013vide SRO-391 dated: 20th september, 2017 made a policy to regularize such commercial concerns in Housing Colonies by imposing different charges for different kind of violation & every body was ready to pay the fees by which JMC would have earned multi crores followed by Housing Board, which was stayed & Govt did not till date bothered to get the stay vacated, which would have lessen the burden of JMC /HB for issuing pick & choose notices is a question on H&UDD as a whole.
It is also to mention here that, following the complaint of 24th April of blackmailer, the owner mailed the factual position with documents on 8th June to JMC, followed by recordings of blackmailer to Officials/Officers of JMC as well but were not read/gone through by any one before issuing such notice speaks of adopting pick & choose by leaving 220 concerns without such notice in only in Channi Himmat, who were served notice in one go by JMC along with said concern, speaks of violation of Art. 14 & 16 of constitution of India & non comliance of Govt's out come on JMC's office letter dated. 01.07.2020 over the same issue, which will give more powers to black mailers to harass innocents.
High Court in OWP No. 470/2015, 449, 450/2015 desealed the buildings running in Gandhinagar, which were sealed by JMC by considering terms of SRO-64 & are still running & JMC did not filed any appeals means agreed to their illegal orders of sealing but therafter also adopting same acts causing harassment to concerns.
As per notice, it is also a question on JMC to see that how many NOCs have been issued by JMC under Sec 324 of JMC Act 2000 in previously running buisiness in Channi, Gandhinagar & Shastri Nagar, Housing colonies at Jammu etc etc & if necesarry, otherwise how buisinesses are running without NOCs, if JMC is so keen of the issue.
If JMC officers are so keen for actions, they should in one go seal all the commercial concerns in all the Housing colonies in Jammu and similarly by SMC in Srinagar but adopting pick & choose for issuing notice in same area, where lot of commercial activitys are going nearby raised a pointer towards their malafidies or anything else.
