High Court asks for personal appearance of Commissioner/Secretary on next date

Srinagar, April 05:  In HIGH COURT OF JAMMU AND KASHMIR AT SRINAGAR titled CPSW No.342/2014 Abid Nazir V/s Mrs Sarita Chauhan & Ors after hearing Hon’ble Mr Justice Ali Mohammad Magrey, Judge ordered as:-

On the previous date of hearing, viz. 1 st of April, 2021, this Court directed as under:-

                 “Despite the judgment dated 29.01.2014 passed in SWP No.109/2013, having attained finality and the instant contempt petition having remained on board for more than six years, the respondent no.1 is not reporting compliance. On the previous date of hearing the respondent no. 1 had been directed to submit the compliance before the next date. It was further made clear that in the event the compliance is not reported court shall resort to coercive methods.

The respondent no.1, however, has not filed the compliance, leaving no option for the Court but to seek his personal appearance.

Accordingly, respondent no.1 is directed to be present in person along with compliance on the next date.

List on 5th April, 2021.

Today, when the matter was taken up for consideration, Ms Asifa Padroo, the learned Additional Advocate General, when asked with regard to the compliance of the aforesaid order qua appearance of respondent No.1 before the Court, submitted that since the order aforesaid was passed only on 1 st of April, 2021, that is only four days ago and, thus not conveyed to the respondent No.1 on time, the respondent No.1 could not come present today before the Court.

The learned Additional Advocate General, in this regard, seeks some more time so to enable respondent No.1 to comply with the terms of the directions passed by this Court on 1st of April, 2021.

The request of the learned Additional Advocate General is acceded to and the matter is adjourned to 15th of April, 2021 for the appearance of respondent No.1 before the Court.

In order to ensure compliance, let a copy of order passed today as well as order dated 1st of April, 2021 be provided to Ms Asifa Padroo, learned Additional Advocate General, under the seal and signatures of the Bench Secretary of this Court, today itself.
