Jammu, Feb 11: Time & again Government issued instructions to work with zeal & dedications to sort out public issues in a specified period of time but in vein.
Once upon a time a blanket ban was imposed for sale of lands, which are nomenclatured as Gair Mumkin Khads in revenue records in reference to orders passed by Hon'ble court in a PIL vide order No. DCJ/SQ/2010-11/1505-39 Dated: 11.08.2010.
Pertinent to mention here that the said PIL was disposed in September, 2017 as water policy was framed & issued vide SRO-456 Dated: 25.09.2017 & stays were lifted into the matter.
Section 5(2) of the SRO clearly stated that Div Com/Deputy Commissioner shal be adjucating Officers for implementation of the policy but matter of great concern that 2 years & 4 months have passed but the bosses prefer to sleep over the issue till date to harass the innocents, whose lands are nomenclatured as Gair Mumkin Khads on the fault of revenue officers.
It is to publish here that Standing order 22 of harvest inspection, which is done twice a year clearly speaks that Patwari has to personally visit the spots of their jurisdiction & right the accurate entry of the land on the day & different % age of test checks were fixed by the Govt up to DC level.
Pertinent to mention here that JDA/Housing Board are constructing their buildings in Gair Mumkin Khads along with Medical College buildings/Govt buildings but innocents are being harssed for their constructions despite no waterbody nearby is clear violation of Art. 14 & 16 of constitution of India, but who to see & act is a question...?
However, Couple of Years ago, some caseswere cleared after getting reports from Flood Control & Revenue Department that there is no restriction of flow of water by the said plot but there after only committes are being constituted & despite clear reporting by both concerned departments the fate of lot of innocents is hanging in the air for no any fault of them.
A grievance was filed in Governors Grievance Cell vide No. 999001100781 against Div Com on 14.03.2019 regarding finalizing the issue as per SRO-456 of 25th October, 2017 in Section 5(2) but after a lapse of 11 months no reply has been given by the Div Com is a matter of concern.
It is also a matter of great concern to publish that in one case of same nature a grievance was filed vide No. 9990011747 dated: 14.03.2019 that despite clear NOCs from Flood Control & Revenue that plot is not in water body, no actions has been taken by DC Office, Jammu but an irrelevant disposal was shown by ACR, Jammu to Grievance Cell vide letter dated: 25.06.2019 that a committe has been constituted by DC vide order dated: 21.06.2019 into the issue but till then the disposal of the case is also hanging in fire as on today.
Thereafter, again one Format was deviced by DC & circulated vide No. DCJ/SQ/Fard-Khads/2019-20/3042 Dated: 20.11.2019 to all SDMs for re submission of cases as per the format but despite again clearance from SDM's on the said proforma with proper NOC, the fate of cases of innocents are still hanging in fire as on tody, speaks that how issues of innocents are being considered in a time bound manner.
It clearly shows that how the genuine public issues are decided by the bosses sitting on top postions in the state.
