Master Plan Of 2021 & Building Bye Laws of 2011 not bothered in J&K & Govt is planning on Master plan of 2031


 

 

JAMMU, Feb 24: Governor had recently viewed Master Plan of 2031 but It is a matter of great concern to publicize that Housing & Urban Development Department, J&K issued a notification dated 09.08.2004 vide SRO 263 as Master Plan Jammu of 2021. It stands mentioned in para b) that the Master Plan of the said area shall come into force from the date of issue of this notification but not followed by the authoritoes in letter & spirit. Violations are permitted for innocents not for influential ones.

It is pertinent to mention here that, it can be observed in actual that who permitted big show room/Automobile showrooms operational in green belt area, others & nearby. In one case of such kind  recently a FIR has been registered against one officer of JMC, who is only plan approval authority but the said big show room of automobile has been permitted to run in Greenbelt area is a matter of great concern to be looked into. Need of the day to just enquire into last  2 years of such kind of cases shall unearth a scam of violations permitted by big ones for vested considerations. It is also to mention here that despite mix land use permitted in Birpur road a commercial plan is not sanctioned by JDA is a matter of concern but lot of buildings are constructed on the same road/opposite without sanctioned plan causing loss of lakhs Govt. exchequer by way of sanction fee.

Building Bye Laws of 2011 in Chapter.3 speaks as:-PROCEDURE FOR SANCTIONING BUILDING PLANS. a) After an application of a building plan has been received, the authority shall immediately forward a copy of plan to concerned departments for their clearance within a period of 4 weeks. If no such clearance is received within the period of three weeks it shall be presumed that that the concerned agency has no objection.

S.No. 15. Time Limit for permission:- a) The Authority shall communicate the decision of the building permission Authority in form A-1 & A-2 to the person giving the notice under regulations 5(a) of the Bye Laws within a period of 60 days from the date of the receipt of the notice. It is also a matter of enquiry to verify whether it has been done by the authority’s.

It is the need of the day to conduct an enquiry into the matter for non compliance of Bye Laws as per the details mentioned below submitted on line & to initiate actions u/r against the defaulting officers to teach them a lesson for noncompliance of Bye Laws or Building Bye Laws of 2011& SRO263 be withdrawn & Mater Plan of 2031 shall again effect innocents not the muscle powers & corrupt officers of the allied departments which is seems to be an eye wash otherwise. The details of withholding NOC’s by the officers w.e.f. 01.09.2015 to 20.02.2016 as per online report, comes under category of dead woods in violation of Laws are as:-

It is very strange on the site of Srinagar Dev. Authority figures of NOC’s shown as zero means no plans.

 It is again very interesting from SMC there is no any plan submitted to ACR,TPO & as per site it speaks 415 plans submitted to Xen. Sewrage& Drainage all pending means no sanction in five months. It is also to mention here that pending NOC’s could not be  understood in JDAs case as there is a big revenue staff posted like Director, Land Management, Tehsildars,Naibs,Girdawer& patwaris and  than NOC’s are being withhold speaks vested considerations in violation of Bye Laws. They have only to see whether the said plot is JDA’s or not & can be sorted out by tally it on the table with mutation of the applicant but not. This speaks of the work culture to harass innocents for sanction of their plans but CTN has lot of complaints against the said section of DLM, JDA for withholding NOC’s but they are keeping their eye shut on illegal constructions in violations.
