Jammu, Nov 11: In C.P./469/2025 (JAMMU) In T.A./111/2023 titled SUNITA SHARMA Vs SHRI SHALEEN KABRA, ADD. CHIEF SECRETARY. AND ORS after hearing CAT ordered as under:-
Vide order dated 03.04.2025 passed in T.A. No. 111/2023 the respondents -the Secretary and the Chief Engineer, PHE Department were directed to issue a regularization order in favour of petitioner No. 4 on a notional basis from the year 2018, i.e., from the date when similarly situated petitioners were regularized, within a period of eight weeks from the date of receipt of a certified copy of the said order.
However, despite the direction being specifically addressed to the Secretary, PHE, and the Chief Engineer, PHE, but the Executive Engineer, Jal Shakti Department stepping into the shoe of Secretary and the Chief Engineer, has rejected the case of the petitioner.
We fail to understand as to how the Executive Engineer, who was not a party to the said direction, has assumed the authority to decide a matter which was to be decided by respondents to whom directions were given by this Court.
By doing so, he has acted as if he were a superior authority to this Court, even assuming his position to that of the Hon’ble High Court or the Hon’ble Supreme Court. Such conduct amounts to interference with the order of this Court, and it is a contempt of the Court.
Accordingly, the Executive Engineer, Jal Shakti Department, is directed to remain personally present before this Court on the next date of hearing and to give an explanation with respect to his conduct.
Compliance report shall be filed within two weeks.
