Chandhigarh, May 22: The Punjab & Haryana High Court has stayed the decesion of Hariyana Govt. to re employee a Superintending Engineer after his superannuation.
In a detailed order it was clarified that whenever a person is re employed the "Chance of promotion of eligible employees & downstream fresh appointments are sacrificed" & thus this can be done only in exceptional circumstances.
High Court also clarified that public interest for re employment cannot depend only on the consideration that a particular officer is efficient but it has to have a component that no other officer is competant enough to that work.

High Court has observed that "What is clear is that when Govt. want to flout the Law it is all 'nudge-nudge wink wink' but when anybody challanges that action,it is sought to be projected as if all the rules are graven in the stone & the Govt. is bound by them"
